The U.S. Supreme Court is one of the most respected and revered institutions in America. For more than 200 years, it has been a bulwark in protecting our liberties. In many cases, the nation’s highest court is the last line of defense for those whose constitutional, God-given rights come under attack. It’s no surprise why the judiciary consistently ranks as the most trusted branch of the federal government, according to.

Today, however, the Supreme Court and America’s judicial system are under heavy attack.

One side of the political aisle—along with activists and organization on the extreme Left—have launched a full-scale effort to “reform” America’s courts. They claim to want to “restore balance” and “fix” the nation’s highest court. Why? Because the Court has allegedly been “stolen” or “captured.”

The 14th Amendment: United States v. Wong Kim Ark

“[T]he Fourteenth Amendment affirms the ancient and fundamental rule of citizenship by birth within the territory, in the allegiance and under the protection of the country, including all children here born of resident aliens . . . ”

Summary
Ratified in 1868, the Fourteenth Amendment opens with the Citizenship Clause.  It reads, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”  The Supreme Court addressed the meaning of this key provision in United States v. Wong Kim Ark.  Wong Kim Ark was born in San Francisco to parents who were both Chinese citizens.

The incident occurred the weekend that preceded May 22 at Saticoy Elementary School in North Hollywood, the school district said.

An LGBTQ flag was burned at an elementary school in Southern California this month ahead of a Pride event, and police are investigating the incident as a hate crime, authorities said.

Newsom says a constitutional amendment is needed to enact common sense gun safety laws supported by the American people

California Democratic Gov. Gavin Newsom wants to change the Constitution to curb gun rights. 

Fed up with inaction on gun control, Newsom unveiled a proposed 28th Amendment to the Constitution on Thursday that would implement "common sense" gun safety measures he claims have widespread bipartisan support.

"Our ability to make a more perfect union is literally written into the Constitution," Newsom said Thursday. "So today, I’m proposing the 28th Amendment to the United States Constitution to do just that. The 28th Amendment will enshrine in the Constitution common sense gun safety measures that Democrats, Republicans, Independents, and gun owners overwhelmingly support – while leaving the 2nd Amendment unchanged and respecting America’s gun-owning tradition."

With all the talk of “abolishing the FBI,” few envision what would happen to our country if we were suddenly left without a federal service to fight interstate crime and child trafficking, conduct effective counterintelligence, and come up with the necessary technology and training for law enforcement and investigators.

Here is an initial plan to get a national conversation started.

The Federal Bureau of Investigation, as its name states, is only a bureaucracy. It is not a sacred institution. It is not a brand to be protected at all costs. It is a bureaucratic structure mandated by law to perform necessary functions to investigate federal crimes, combat foreign spies, and not much more.

Appeals court denies Biden admin request for stay in challenge to migrant release policy

The 11th Circuit Court of Appeals on Monday denied the Biden administration’s request for a stay on an order blocking the implementation of a controversial policy that saw thousands of migrants released into the U.S. without a court date in the short time it was in place.

A federal judge had blocked the administration’s "parole with conditions" policy in May, a day after it was implemented amid a surge in migration to historic highs just ahead of the end of Title 42 expulsions on May 11. The administration has said that nearly 9,000 migrants were released in the time the policy was in place.

The judge found that the policy, which saw migrants released into the U.S. without court dates and told to check in with Immigration and Customs Enforcement within 60 days, was materially identical to a separate policy that paroled migrants into the U.S. while enrolling them into alternatives to detention (ATD) programs. The judge had blocked that policy in March in response to a lawsuit from Florida Attorney General Ashley Moody, who also filed the May challenge.

Are congressional Republicans about to greenlight a CBDC?

If Republicans want to prevent the introduction of a central bank digital currency (CBDC) that would allow government to track and control your purchases, they’d better scrutinize the two anti-CBDC bills before Congress. There’s a huge difference between them. 

One would prevent a CBDC surveillance token from replacing the American dollar. The other would actually greenlight a CBDC by government-chosen contractor.  

It would be tragic if a China-style CBDC is forced on the American people by Republicans who, at best, didn’t understand what they voted for.

The dishonestginnedup campaign to smear originalists on the Supreme Court has always been predicated on half-truths and innuendo. But Slate’s Mark Joseph Stern is now accusing Samuel Alito of “violating” completely imaginary SCOTUS ethic “rules” in a case involving Phillips 66.

According to Stern, even when originalist justices properly disclose all their investments and then recuse themselves, they’re still corrupt. Why?

Special counsel John Durham is scheduled to testify on Capitol Hill in June following the publication of his report that strongly criticized the FBI for its handling of investigations pertaining to the 2016 Trump campaign and Russia, reports said on Friday.

In May 2019, John Durham was appointed to investigate Crossfire Hurricane, the FBI’s 2016 investigation into Trump-Russia collusion, and associated matters.

In December 2020, former Attorney General Bill Barr granted Durham special counsel status to safeguard the investigation during the transition from former President Donald Trump to President Joe Biden.

Supreme Court: Yes, the IRS Can Secretly Obtain Your Bank Records

The Supreme Court has sided with the IRS in a case that involves owing the IRS money, bank records, taxpayer privacy, and notice.

The IRS has scored a win at the U.S. Supreme Court. last Thursday, the court released its ruling in Polselli v. IRS, involving whether the agency can access bank records of a taxpayer’s relatives or associates — without notice — to help with tax collection efforts. The Supreme Court’s answer is yes. Under an existing statute, the IRS can secretly probe your bank records and potentially your relatives’ bank records without notice.

“The question presented is whether the exception to the notice requirement applies only where a delinquent taxpayer has a legal interest in accounts or records summoned by the IRS under Section 7602(a). A straightforward reading of the statutory text supplies a ready answer: The notice exception does not contain such a limitation,” Chief Justice Roberts wrote in the unanimous opinion.

U.S. Supreme Court Balances Power Between Employers and Unions in Latest Ruling

Glacier Northwest, Inc. v. International Brotherhood of Teamsters concerned the limits of the protections granted by the NLRA

NFIB applauds today’s decision in the case Glacier Northwest, Inc. v. International Brotherhood of Teamsters at the U.S. Supreme Court. The Court determined that the National Labor Relations Act (NLRA) does not immunize the intentional destruction of an employer’s property. NFIB filed an amicus brief in the case arguing that the NLRA does not preempt suits similar to the one presented in this case.

“Today’s decision reaffirms the established balance of power between labor unions and employers,” said Beth Milito, Executive Director of NFIB’s Small Business Legal Center. “The NLRA does not preempt legal action when employers are facing harassment and vandalism. Small business owners have the right to seek a remedy when their property and livelihoods are intentionally damaged.”

Governor Whitmer Takes a Stand on Gun Control, Signs ‘Red Flag’ Laws for Michigan…

Michigan Democratic Gov. Gretchen Whitmer signed legislation Monday that will make it easier for authorities to seize firearms from persons who are thought to pose a danger to themselves or others, often known as “red flag” laws.

“Extreme risk protection orders have been proven to reduce suicides, save lives, and keep guns out of the hands of domestic abusers and violent criminals,” Whitmer said in a statement released on Monday.

According to a legislative analysis of the bill published by the Michigan House of Representatives, Senate Bill 83 allows certain individuals to file a “extreme risk protection order” with the circuit court if “evidence supports that a respondent poses a significant risk of self-injury or injury to others by possessing a firearm,” according to a legislative analysis of the bill published by the Michigan House of Representatives.

132 Dems vote against bill cracking down on fentanyl, cite ‘inequities’ in criminal justice system

A GOP lawmaker replied to Democrat objections that Republicans 'don't apologize' for tough drug sentences

The House on Thursday passed legislation that would permanently classify fentanyl-related substances (FRS) as Schedule I drugs that are subject to the toughest federal prison terms and penalties, over the objection of most Democrats.

Lawmakers approved the Halt All Lethal Trafficking of Fentanyl Act in an 289-133 vote that saw 132 Democrats oppose the bill even though the White House signaled support for it. In the final vote, 74 Democrats supported the bill and only one Republican voted against it.

Supporters of the bill have argued that there are thousands of fentanyl analogues that cannot be analyzed quickly enough to understand which are harmful and which are not, which is why all fentanyl-related substances need to be classified in Schedule I. FRS has been temporarily classified that way on an emergency basis since 2018, and the House bill would make that permanent.

Supreme Court sides with elderly woman who lost condo to Minnesota county

The Supreme Court on Thursday ruled in favor of a 94-year-old woman who challenged a Minnesota county that seized and sold her condo to pay off her tax debt and then kept a $25,000 profit.

In a unanimous ruling, the justices said Hennepin County violated the U.S. Constitution’s Takings Clause, which prohibits the government from taking property without just compensation.

Geraldine Tyler lost her condo in a dispute with county officials after she owed $15,000 in property taxes. She had purchased it in 1999 but moved into a senior living facility in 2010. After moving out, she did not pay taxes on the property.

The county foreclosed on the condo, sold it for $40,000 and kept all the money instead of returning the $25,000 left over after the $15,000 tax debt was paid.

Ms. Tyler lost her initial challenge in lower court, prompting her to take the dispute to the high court.

House Fails To Overturn Biden’s Veto Of Bill Repealing Tariff Exception For Chinese Solar Panels

The House of Representatives failed on Wednesday to overturn a veto by President Joe Biden of a bill passed by Congress that would repeal his tariff exemptions to solar panels made with Chinese components, which was granted to further his climate agenda.

Both houses of Congress, on May 4, passed a bill to repeal the “Procedures Covering Suspension of Liquidation, Duties and Estimated Duties” issued by the administration, which suspended tariffs on “crystalline silicon photovoltaic cells” – a component of solar panels made using parts from China. Republicans have said that the rule will effectively remove photovoltaic cell tariffs on China – enabling them to ship components to other countries, which then send finished panels to the U.S. – as well as benefit Chinese firms using the “slave labor” of China’s Uyghur Muslim population to make the components. (RELATED: ‘Build Back Beijing’: Biden Waives Solar Tariffs In Massive Win For Chinese Industry)

The vote to overturn the veto was 214-205, garnering a majority of support in the House but well below the two-thirds majority required to overturn a veto under the Constitution. The effort had first passed the Republican-majority House by a vote of 221-202 and the Democratic-majority Senate by a vote of 56-41, garnering bipartisan support in each chamber, even as Biden vowed to veto the bill and did so.

A Key Trump-Era Policy’s End Will Be The ‘Demise’ Of The US’ Immigration Courts, Experts Say

  • Title 42, the Trump-era public health order, ending May 11 will break the U.S. immigration court system, according to a senior Immigration and Customs Enforcement (ICE) official, who spoke with the Daily Caller News Foundation, a former U.S. immigration judge and recent data showing the extent of the immigration court backlog.
  • The number of cases the Executive Office of Immigration Review (EOIR) oversees continues to rise, more than tripling to 1,791,304 pending cases in 2022, with 313,849 completed.
  • “Title 42 ending will be the demise of the immigration court system,” a senior ICE official close to the matter and not authorized to speak publicly, told the DCNF.
